  Definition of Luxury Car Services

A self drive car rental fleet that specialises in the top of the range vehicles – both sedan and 4X4's along with a range of 2 and 4 seater convertibles. The Luxury Car team understands the privilege of privacy and have been specially trained to ensure that every rental is a memorable experience. The service includes personal meet and greet at both delivery and collection of the vehicle, iced bottled water in the vehicles, a selection of CD's tailored to the customer's individual taste and a personal 24 hour contact number for the duration of the rental to ensure that the customer is given the best personal service throughout.

  Delivery and Collection Charges / One Way Charges Within South Africa

Please refer to the schedule of charges Rates File. If the destination is not on the attached table the rates will be subject to the written quotation supplied by Avis Luxury Cars. Please note that the only destinations that do not attract a delivery / collection fee is when a vehicle is rented and returned from the same listed International Airports Cape Town, Johannesburg and Durban.

  Drivers Licence

  • The renter is obligated to inform Avis Luxury Cars of an additional driver. The driver is subject to the same licence conditions as the renter. (If Avis Luxury Cars is not informed, all waivers accepted will become null and void).
  • Driver's licences must be valid for a minimum period of 5 years. It is a legal requirement in South Africa for driver's to be in possession of their original driver's licence at all times whilst driving a vehicle.
  • Copies of all driver's licences will be necessary at point of check out to support the listed driver's on the rental document.

  Petrol

This is not included in the rates. Cars are delivered full and customers are charged for refuelling the vehicle upon termination of the rental.

  Rental Contract Fee

R30 contract fee which will be payable by the client at time of check out. This is an administration fee to cover admin costs and will apply to each and every rental.

  Additional Driver Fee

All drivers must be listed on the applicable rental agreement. There is a charge of R225 per additional driver, per rental. If Avis Luxury Cars is not informed, all waivers accepted will become null and void and the full costs of any loss / damage will be charged.

  Underage Driver Surcharge

  • The renter and any additional drivers must be 25 years of age and have been in possession of a driver's licence for a minimum of 5 years.
  • The renter and any additional driver can be 21 years of age if in possession of a Diners or American Express credit card, which must be used to settle the account. This is subject to an additional levy being charged of R350.00 per rental day for every renter / driver over 21 years of age and under 25 years of age.
  • Please note all rentals where the driver is under 25 years of age will be subject to the discretion of management.

  No Show / Cancellation Fees

  • All confirmed bookings that are cancelled 7 days or less prior to the check out of the rental will be subject to a cancellation fee. The fee will be the equivalent of 2 days rental at the contracted rate.
  • All no shows that are not cancelled in writing, will be billed at the confirmed number of days billed by the tour operator.
  • Once the rental has commenced the number of rental days confirmed to the tour operator will be billed irrespective of whether the customer terminates the rental earlier than reserved. No refund will be processed in this instance.

  Traffic Fine Handling Fee

  • In the event of any traffic offence taking place during the rental the driver must be aware that an NDC form (the affidavit required by the Department of Transport) will be completed to transfer the fine and penalty points to the individual. A fine administration fee of R150 will be charged in each instance.

  Accident Management

In the event of an accident, the driver of the vehicle is obliged to inform Avis Luxury Cars within 6 hours of the incident. Under no circumstances may the driver or the renter arrange to have the vehicle towed from the scene of the accident without prior arrangement with Avis Luxury Cars. Avis Luxury Cars will need a detailed accident report from the driver / renter, as well as information about the other vehicle/s involved in the accident with names of witnesses and the police station where the accident was reported to. An accident administration fee of R500 will be charged per incident.

  Authorisation Taken on Customer's Credit Card

Please note that payment by credit card will be handled in the following way. The authorisation for the estimated rental amount (including the applicable excess) will be collected from the bank 24 hours prior to the check out. The actual debit to the credit card will be done after termination of the rental.

  Over Border Rentals

No vehicles on the Luxury Car fleet that may be taken out of South African borders.

  • If the vehicle is taken out of the borders of South Africa and any of the waivers were accepted (CDW,TLW), these waivers will become null and void. The renter of the vehicle will then be responsible to Avis Luxury Cars for the full cost of any damage to the vehicle caused by accident, break-ins or third party as well as all passenger liability claims. In the case of theft of the vehicle the renter will be responsible to Avis Luxury Cars for the replacement of the vehicle at the current market value of the vehicle in the country in which the theft took place.
  • Avis Luxury Cars reserves the right to invoke breach of contract in this instance.

  Terms of Payment

Recognised bank charge cards, American Express, Diners Card, Visa and MasterCard's are acceptable methods of payment. Any travel agent or company that has an authorised billing method approved by Avis Rent A Car. Debit Cards and Cash are not accepted as a method of payment.

  Rates

Rates are applicable only when pre-reserved and pre-paid to an Avis appointed Tour Operator. Such Tour Opeator must hold an Avis Billing Account and be in possession of Avis vouchers. Should you require to establish a billing account please contact your local Avis office.

  Waivers

Rates include limited coverage of passenger liability and third party motor liability. Such cover being subject to the terms and conditions of the Avis policy and insurance as is customary in South Africa / Swaziland and Lesotho. Cover for loss by fire is also included together with cover for damage to the Avis car, excluding the applicable responsibility, but does not include loss or damage through incidents of civil unrest. Insurance does not cover personal property. If Collision Damage Waiver and/or Theft Loss Waiver are not taken, Avis Luxury Cars will require an additional deposit to cover the full excess (replacement value of the vehicle at the time of the accident / theft determined in South Africa Rands purchased in South Africa)

  Collision Damage Waiver and Theft Loss Waive

The rates include access to Collision Damage Waiver and Theft Loss Waiver. However, a non-waiverable responsibility will be levied in the event of damage to the vehicle and/or part thereof as a result of collision, or theft of the vehicle or part thereof. Please note that these amounts are subject to all terms and conditions being adhered to by the customer / driver. In the event of breach of any nature Avis Luxury Cars will invoke full breach, by ways on issuing a summons on the customer in South Africa. The full excess (replacement value of the vehicle at the time of the accident / theft determined in South Africa Rands purchased in South Africa) will then be charged to the customer.

Please note that the applicable cover will fall away completely if:

  • At the time of the damage and/or theft, the driver of the vehicle is under the influence of alcohol, illegal and/or banned substances.
  • At the time of the damage the driver of the vehicle is breaking the speed limit – the vehicles management system will be used to determine this and provide the evidence in court.
  • The damage and/or theft was caused by the fault or negligence of the renter and/or driver of the vehicle.
  • The damage and/or theft occurred in a situation where no other vehicle or animal or object was involved.
  • The driver of the car at the time of the damage and / or theft is not an official authorised "additional driver" recorded on the rental documentation.
  • If vehicles are taken into countries out of South Africa, the renter will be responsible for the full value of damage to the vehicle. In the case of theft the renter will be responsible for the full value of the vehicle based on the current market value of the vehicle in the country where the accident/theft took place.
  • If sedan vehicles are driven on a road which is not tarred or generally where the road condition was not suitable for the vehicle.
  • If 4x4 vehicles are driven on a road which condition was not suitable for the vehicle.

  Personal Accident Insurance

Personal Accident Insurance (PAI) - The renter who accepts Personal Accident Insurance as well as all other passengers in the vehicle will be covered for accidental bodily injury while driving, riding in, getting into or out of the Avis vehicle. Coverage is in effect up to "return date" indicated on the rental agreement or any Avis approved extension. The insurance will apply to persons up to the age of 75. The death benefit in respect of persons under 15 years of age shall be limited to R 10 000.00. The benefit will be divided equally among all occupants of the insured vehicle.

NOTE: The insured shall give immediate written or telegraphic notice to Avis of any claim and in any event within 90 days of injury. Avis acts as agent for Accident and Miscellaneous Acceptances , who is the underwriter of the PAI Policy . All benefits in terms of the PAI Policy are subject to the terms and conditions of the underlying policy.

The purchasing of PAI ensures the following covers

  • Accidental Death & Permanent Disability: A payout of up to R200,000.00 per person per incident and limited to R 500 000.00 per Avis vehicle per incident in the event of accidental death or permanent disability.
  • Emergency Medical Expenses: A payout of up to R250,000.00 per vehicle per incident for emergency medical expenses incurred whilst driving, riding in or getting out of an Avis rented vehicle.
  • Guaranteed Hospital Admission: A guarantee up to R5,000.00, which guarantees admission to the hospital. This is refundable by the member or the member's medical aid.
  • Contingent Liability: Up to R2,500,000.00
  • Contingent Third Party Liability Cover: for the driver of the Avis vehicle in his/her personal capacity
  • Funeral Benefits: Upon the death of the driver of the Avis rented vehicle, Avis will make the necessary arrangements to return the body to the driver's hometown and will further pay up to R 20 000.00 towards the deceased driver's funeral.
  • Travel Delay Cover: A payout of up to R2,000.00 towards transportation or accommodation should the member be stranded after a mechanical breakdown or after a motor vehicle accident.

  Emergency Medical Assistance

NOTE: The policy does not cover any loss from intentionally self-inflicted injuries, suicide or any attempt threat, sickness or disease, full time active service in the armed services of any country or declared or undeclared war. This leaflet is for illustration only. Full details are contained in the Master Policy, which will be made available for inspection.

Over and above our PAI cover we offer the following services to all our customers: If within 24 months from the date of an accident, bodily injury result in death or disability, an amount will be paid in accordance with the benefits below:

Injuries resulting in permanent total disability from following occupation or any other occupation for which such person is fitted by knowledge or training. Shall mean all costs and expenses necessarily incurred, within 24 months of the defined event for artificial aids, prosthesis, medical, surgical, dental, nursing home or hospital treatment as a result in accidental bodily injury. A deduction of R250.00 will apply.

Trauma Counselling: Trauma Counselling Service offers a professional telephonic counselling service to the renters who find themselves victims of hi-jacking, car theft, robbery or general accident and motor related trauma. If further counselling is required, we will pay up to R5,000.00 per annum per beneficiary for a consultation with a therapist, psychiatrist or psychologist.

  Vehicle Breakdown/Accident Assistance Procedure

  Insurances - Passenger Liability and Third Party Motor Cover

Third Party Motor Liability including Passenger Liability: The Avis Rental Agreement indemnifies the renter and any other authorized driver against claims which they become legally liable to pay consequent upon accidental death of or bodily injury or illness or accidental loss of or physical damage to tangible property resulting from the negligence of the renter or authorized driver whilst driving the hired vehicle.

Total Cover: Total Cover Limit: In excess of R209,000,000 applies to Avis Luxury Car vehicles registered in South Africa travelling in South Africa. It excludes travel outside of the borders of South Africa.

  • In accordance with all South African laws, all Third Party claims are first processed via the Multilateral Motor Vehicle Accident Fund Act 93 of 1989 (MMD – which deals with death and injury claims). Should the MMF not fully honor the claims, the Avis Policy should come into effect. The MMF does not deal with property damage claims.

  Main Exclusions

If any of the following circumstances apply at the time of injury or damage to the Third Party or their property, the renter or driver will not be covered by the policy:

  • Unauthorized driver not registered on the Rental Agreement.
  • The rented vehicle was not in roadworthy condition.
  • The driver was exceeding the speed limit.
  • The renter will also be responsible if the vehicle was driven on unsuitable roads.
  • The driver was under the influence of liquor / drugs.
  • The driver was not holding a valid driver's licence.
  • Carriage of fare paying passengers.
  • Carriage of passengers in excess of the particular vehicle's capacity.
  • Death of or bodily injury to any person in the employment of the renter / driver arising from and in the course of such employment.
  • Death of or bodily injury to a member of the same family / household as the renter / driver (spouse or child)
  • The renter / driver is entitled to indemnity under any other policy.
  • The renter / driver has not been refused motor vehicle insurance by any insurance company / underwriter.
  • The renter / driver will not be covered for any consequential losses or damage or for contractual liability incurred unless such liability would have attached notwithstanding any contractual agreement.

  The Check Out Procedure

All clients are personally met by a member of the Avis Luxury Car team. Please note that the staff are in a BLACK uniform not the traditional AVIS red.

  • All hotel deliveries will be done in the normal way with the Luxury Car staff requesting that the concierge desk calls for the client.
  • If the delivery location is an airport the staff will be waiting for the client with a sign that says "Welcome Mr xxxxxx" in the AIRPORT TERMINAL.

The signage is not marked with Avis Luxury Cars to provide our client's with an understated service. If a client does not want his name used to protect his identity, please provide us with a name that we should use on the board which he will respond to. The staff will then assist the client with his baggage to his vehicle, which is parked as close to the airport terminal as is possible.

Please note that at check out of the vehicle the staff will do a complete quality check of the car. The client will be asked to sign a quality document where any damage will be noted. Any CD's supplied will also be listed along with their prices, so that if the client decides to keep them he will be billed on the rental agreement. Any additional extra's provided will also be listed ie. umbrellas, babyseats, iced water etc.

  The Check In Procedure

  • All hotel collection will be done in the normal way with the Luxury Car staff requesting that the concierge desk calls for the client.
  • If the collection location is an airport the staff will be waiting for the client at the departure terminal confirmed by the client when taking delivery of the car.

The client will be requested to sign off the quality documentation, where any discrepancies between the check out and check in will be for the client's account. The staff will then assist the client with his baggage to the check-in counter.

  Minimum Rates Charge

Rates are calculated from time of pick-up to time of drop-off, with the minimum rental period being 24 hours on all self drive rates.

  Value Added Tax

All rates quoted are inclusive of VAT except on the copy of the rental agreement. The rental agreement which will be issued at time of check out will reflect the rate excluding VAT, with the VAT amount appearing separately in box 55.

  Passport/Identification

The renter and additional driver are obliged to present either a valid passport or valid recognised country identification at the time of check-out.

  Personal Service

While kilometres are taken to and from Avis Luxury Cars premises, we meet our customers personally at airports, hotels, railway stations or any other requested destination.
